GENERAL TERMS AND CONDITIONS OF SALE (GTCS)

Article 1 – Purpose and Scope

These General Terms and Conditions of Sale (hereinafter the “GTCS”) govern all sales of products and services concluded between ALTAXIS and any natural person or legal entity (hereinafter the “Customer”) via the websites operated by ALTAXIS (hereinafter the “Website”).

The GTCS apply to the exclusion of any other terms or conditions, unless expressly agreed in writing by ALTAXIS.

Placing an order on the Website implies full, unconditional, and irrevocable acceptance of the GTCS in force on the date of the order.

Article 2 – Definitions

For the purposes of these GTCS:

• “Customer” means any natural person aged at least 16 years, or any legal entity, placing an order on the Website.

• “Services” means any coaching, workshops, seminars, training sessions, or other intangible services offered by ALTAXIS.

• “Products” means any physical or digital goods offered for sale on the Website.

Article 3 – Eligibility and Age Restrictions

The purchase of Products is restricted to individuals aged 16 years or older.

The purchase of Services is restricted to individuals aged 18 years or older.

ALTAXIS reserves the right to request proof of age at any time. In the event that a Customer does not meet the applicable age requirement, ALTAXIS reserves the right to cancel the order, terminate access to the Services, and issue a refund where applicable. Where Products have already been delivered, ALTAXIS may require their return prior to issuing a refund.

Article 4 – Orders

Orders are placed exclusively via the Website, using the ordering process provided therein.

All orders are subject to acceptance by ALTAXIS. ALTAXIS reserves the right to refuse or cancel any order in the event of:

• Non-compliance with these GTCS;

• A dispute with the Customer;

• Suspicion of fraud;

• Non-payment or partial payment;

• Any other legitimate reason.

An order shall only be deemed final upon confirmation by ALTAXIS and full receipt of payment.

Article 5 – Prices

All prices are stated in euros (€), inclusive of all applicable taxes, including value added tax (VAT) at the applicable rate on the date of the order, and exclusive of delivery and processing costs.

ALTAXIS reserves the right to modify its prices at any time. However, Products and Services shall be invoiced at the price in effect at the time the order is confirmed.

Delivery costs are specified prior to final validation of the order and are invoiced in addition to the price of the Products.

Article 6 – Payment Terms

Payment is due in full on the date the order is placed, including for pre-orders.

Payment may be made by credit or debit card. Accepted cards include Mastercard and Visa international bank cards. American Express is not accepted.

Secure online payments are processed by Stripe. Payment data is encrypted using industry-standard security protocols. ALTAXIS does not store full payment details.

ALTAXIS shall not be held liable for any malfunction, interruption, or security breach attributable to the payment service provider.

ALTAXIS reserves the right to suspend or cancel any order in the event of non-payment or payment incident.

Article 7 – Delivery

Products are delivered to the address provided by the Customer at the time of ordering. The Customer is solely responsible for the accuracy and completeness of the delivery information.

Delivery times are provided for information purposes only and are not contractually binding, unless expressly agreed otherwise.

Risk of loss or damage to the Products passes to the Customer upon dispatch from ALTAXIS’ premises.

In the event of loss or damage during transport, the Customer shall notify ALTAXIS without undue delay. ALTAXIS shall, where appropriate, provide a replacement Product or issue a refund in accordance with applicable legal guarantees.

Digital Products and Services are deemed delivered upon provision of access to the Customer.

Article 8 – Right of Withdrawal

Where the Customer qualifies as a consumer within the meaning of applicable consumer protection legislation, the Customer may benefit from a statutory right of withdrawal.

Unless an exception applies under applicable law, the withdrawal period is fourteen (14) days from:

• The date of receipt of the Product; or

• The date of conclusion of the contract for Services.

The right of withdrawal does not apply to:

• Fully performed Services for which performance has begun with the Customer’s prior express consent and acknowledgment of waiver of the right of withdrawal;

• Digital content supplied in intangible form once performance has begun with prior express consent;

• Goods made to the Customer’s specifications or clearly personalised.

To exercise the right of withdrawal, the Customer must notify ALTAXIS by means of an unambiguous written statement.

Returned Products must be sent back in their original condition. The Customer shall bear the direct cost of returning the goods unless otherwise required by law.

Article 9 – Legal Guarantees and Liability

ALTAXIS is bound by the legal guarantees applicable under European Union law and any mandatory national legislation.

ALTAXIS shall not be liable for indirect or consequential damages, including loss of profit, loss of opportunity, or loss of data, arising out of the use of the Products or Services.

In any event, ALTAXIS’ total liability shall be limited to the amount paid by the Customer for the relevant order, except where liability cannot be excluded or limited by law.

Article 10 – Personal Data Protection

Personal data is processed in accordance with applicable data protection legislation, including Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR).

The purposes, legal bases, retention periods, and conditions of processing are described in the Privacy Policy available on the Website.

Customers have the right to access, rectify, erase, restrict, or object to the processing of their personal data, as well as the right to data portability, in accordance with applicable law.

Marketing communications may be sent to Customers who have provided their email address. Customers may unsubscribe at any time via the unsubscribe link included in each communication

Article 11 – Intellectual Property

All content available on the Website, including but not limited to texts, graphics, logos, videos, training materials, and digital Products, is protected by intellectual property law and remains the exclusive property of ALTAXIS or its licensors.

Any reproduction, distribution, modification, or unauthorised use is strictly prohibited.

Article 12 – Governing Law and Jurisdiction

These GTCS shall be governed by and construed in accordance with Irish law, without prejudice to mandatory consumer protection provisions applicable in the Customer’s country of residence.

In the absence of amicable resolution, any dispute arising in connection with these GTCS shall be submitted to the competent courts in accordance with applicable law.
